GuestSpot User Agreement (Revised Plain-Language Summary)
Welcome to GuestSpot! This summary gives you a clear, plain-language overview of our Terms of Service. If there is ever a conflict between this summary and the full Terms, the full Terms control as the legally binding document.
Think of this as the quick guide to what you can expect from us and what we expect from you.
1. Who Can Use GuestSpot
- Adults Only: You must be 18 or older (or the age of majority where you live, if higher) to use GuestSpot.
- Honest Info: Sign up with your real name and accurate information.
- One Account: Maintain a single account. If you run a shop and also have an artist profile, we will guide you without duplicating accounts.
- No Minors: Accounts for minors are not allowed, and you may not let a minor use your account.
2. Your Account Responsibilities
- Keep It Secure: Do not share your password. You are responsible for everything that happens on your account.
- Update Info: Keep your email, phone, and other key details current so we can reach you with important notices.
- Professional Conduct (for Providers): Present yourself accurately.
- List the correct business hours, prices, and services you actually offer.
- Maintain required licenses or permits and follow local laws, including health regulations.
- Treat clients with respect and professionalism.
3. Booking and Payments
- Booking Deposits: Clients pay a deposit set by the Provider, which goes to the artist or shop once the appointment happens.
- 5% GuestSpot Fee: A 5% platform fee is added on top of the deposit. It keeps GuestSpot running and is non-refundable once paid.
- Providers Get the Full Deposit: GuestSpot does not take a cut of your deposit. We only keep the 5% platform fee.
- Payments Stay on Platform: All initial payments must flow through GuestSpot's secure payment partner. Off-platform payments to avoid fees violate the rules.
- Final Payments: Remaining balances are handled directly between client and Provider (often at the appointment) unless otherwise noted.
4. Cancellations & Refunds
Life happens—here is how we handle changes:
- Client Cancels Early: Cancel at least 48 hours before the appointment to receive your deposit back. The 5% fee is not refunded.
- Client Cancels Late: Cancel within 48 hours (or no-show) and the deposit is forfeited. The 5% fee also remains non-refundable.
- Provider Cancels: If the artist or shop cancels, the client receives the deposit back. GuestSpot may also refund the 5% fee as a courtesy, especially for last-minute cancellations.
- Changing Plans: When both parties agree to reschedule, the existing deposit can usually move to the new date. Communicate and loop in GuestSpot if you need help.
- No-Shows: A client no-show forfeits the deposit. If a Provider no-shows, contact us so we can assist and make it right.
- Product Purchases: Refunds or returns for products bought through GuestSpot's marketplace are handled between the buyer and the seller. GuestSpot will help facilitate communication, but the seller is responsible for resolving product issues.
5. Be Good – Community Rules
We expect everyone to behave respectfully.
- No Jerks Allowed: Bullying, harassment, hate speech, or discrimination are not tolerated.
- Stay Legal: Do not use GuestSpot for illegal activity or to violate tattoo regulations in your area.
- No Scams: Do not defraud people or the platform.
- Don't Ditch the Platform: Providers and clients should not move transactions off GuestSpot to avoid fees.
- No Spam or Bots: Communicate authentically. Do not send mass unsolicited messages or scrape data.
- No Offensive Content: Avoid unlawful or extremely graphic content, and never post sexual content involving minors or materials glorifying violence or self-harm.
- Keep It Professional: Present yourself professionally in listings and communication. Showing up prepared is part of respecting each other.
- Consequences: Violations may lead to content removal, warnings, suspension, or banning, and serious incidents may be reported to authorities.
6. Content You Post
- You Own Your Content: Anything you upload remains yours.
- License to GuestSpot: You give us permission to use your content on the platform and in GuestSpot marketing to promote the community.
- Post What's Yours: Only upload content you have rights to share.
- Be Accurate: Make sure descriptions and claims you post are truthful.
- Respectful Reviews: Reviews should be honest and civil. Artists should not pressure reviewers to remove feedback.
- Content Removal: We may remove content that violates policies or law and will explain when possible.
- Copyright Complaints: Report infringements and we will act quickly under the DMCA.
7. Disputes & Issues
- Talk First: Clients and Providers should try to resolve issues directly.
- We Can Help: Contact us if you need assistance mediating, though we cannot guarantee a specific outcome.
- No GuestSpot Liability: We are not responsible for what happens between users; we facilitate introductions and bookings.
- Release: You agree not to pursue GuestSpot for disputes with other users.
- Chargebacks and Fraud: Report suspicious charges or bookings promptly so we can assist.
8. Ending Your Account
- Leaving: You can delete your account at any time via settings or by contacting support.
- Permanent Deletion: Account deletion happens from your profile page. Once you delete your account, there is no going back. Please be certain. Permanent deletion removes your profile information, all portfolio items, all bookings, your photos and images, and your account settings and preferences.
- Our Termination Rights: We may suspend or ban accounts that violate the rules or pose risks.
- After Termination: If an account ends, a few things happen.
- Your profile is no longer visible.
- Upcoming bookings may be cancelled, with deposits refunded or forfeited based on circumstances.
- Some history, like past reviews, may remain for recordkeeping.
- Certain terms continue to apply, such as limitations of liability.
- Notifications: Adjust marketing preferences any time, though you may still receive essential account or legal notices.
- Data Handling: We delete or anonymize personal data per our User Agreement but retain necessary records for legal or business reasons.
9. Our Liability and Your Risks
- Platform As Is: GuestSpot is provided without guarantees of uninterrupted availability.
- No Guaranteed Outcomes: We cannot promise specific bookings or results.
- Liability Limits: Our responsibility is limited, and we are not liable for indirect or consequential damages.
- No Warranty on Services or Products: Providers are responsible for their work and items; remedies come from them or their insurance.
- Indemnity: If your actions cause claims against GuestSpot, you agree to cover our costs.
- No Insurance Provided: GuestSpot does not supply insurance; Providers should carry their own coverage.
10. Other Important Stuff & Contact
- Privacy: Using GuestSpot means agreeing to our User Agreement and data handling practices.
- Governing Law: Delaware, USA law generally applies, while local consumer laws may grant additional rights.
- Dispute Resolution: U.S. users agree to arbitration with a class action waiver, with opt-out rights within 30 days and exceptions where local law requires.
